Landlord Rights in Rent Collection and Security Deposit Disputes
When tenants refuse to pay rent, your first instinct might be to move forward with eviction. However, cases in which tenants refuse to pay rent — as opposed to being unable to afford the rent — are rarely simple disputes.
Tenants sometimes refuse to pay rent for a reason that seems legitimate — such as a problem with electricity, gas, water or other landlord-provided utilities. Before agreeing to any settlement, you should know the Tennessee Residential Landlord-Tenant Act requires tenants to notify you in writing and give you an opportunity to fix the problem before they can withhold rent.
Likewise, disputes about the return of security deposits are not cut-and-dried. There are laws intended to protect renters from losing their security deposits unjustly, and you may need to document your claims in case of a dispute.
